These Terms of Purchase (“Terms”) govern every purchase of digital books (“eBooks”) or any other products or services (collectively, “Products“) offered on emporiumlearning.com (the “Site”), which is owned and operated by DYNAMIC EMPORIUM LLC, 2335 Lanning Way San Jose, CA 95133 (“Company,” “we,” “us,” or “our”).
Your use of the Site and any purchase made through it are also governed by our Terms of Use and Privacy Notice, which are incorporated herein by reference.

PLEASE READ THESE TERMS CAREFULLY. BY COMPLETING A PURCHASE OR ACCESSING ANY PRODUCT THROUGH THE SITE YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS‑ACTION WAIVER IN § 11 BELOW. IF YOU DO NOT AGREE, DO NOT PURCHASE OR USE ANY PRODUCT.

You represent and warrant that you (i) are at least 18 years old (or the age of majority in your jurisdiction), (ii) have full legal capacity to enter into a binding contract, and (iii) are not barred from purchasing or receiving digital content under any applicable law.

2. Compliance With Laws

You agree to use the Site and Products in strict compliance with all applicable laws, regulations and third‑party rights. You are solely responsible for determining that an eBook or other digital file may be lawfully downloaded, imported and used in your jurisdiction.

3. Privacy

Our collection, use and disclosure of personal data is described in the Privacy Notice. By purchasing a Product you consent to all processing of your personal information described therein.

4. Order Processing & Payment

Placing an Order. When you click “Buy Now” or a similar button you are making a binding offer to purchase the selected Product at the price and terms displayed.
Confirmation. Shortly after payment you will receive (a) an on‑screen confirmation, and (b) an email containing your download link(s), licence details and receipt. Most links are delivered within minutes, but please allow up to 24 hours in case of payment‑gateway delays.

Right to Decline / Cancel. We may refuse or cancel any order—for example, in case of suspected fraud, pricing error, or legal compliance issues. If we cancel an order after your card has been charged, we will promptly issue a full refund to the original payment method.
Pricing Errors. While we strive for accuracy, typographical or system errors may occur. If the correct price is higher than the price displayed at checkout, we will contact you for instructions before processing or will cancel and refund the order.

5. Product Descriptions & Availability

Accuracy. We endeavour to describe Products accurately, but we do not warrant that descriptions, metadata, screenshots or sample pages are complete, current or error‑free.
File Formats. Unless otherwise indicated, eBooks are supplied in PDF and/or EPUB formats and are intended for reading on standard devices and apps. It is your responsibility to ensure compatibility before purchase.
Download Window. Download links remain valid for at least 30 days. We recommend saving a backup copy promptly.
Withdrawal of Titles. Digital rights or other circumstances may require us to withdraw or disable a title even after purchase. If that occurs before you have downloaded a copy, we will offer an equivalent replacement or a refund at our sole discretion.

6. Licence & Usage Rights

Purchasing an eBook grants you a non‑exclusive, non‑transferable, revocable licence to download and use the file(s) for your personal, non‑commercial use on up to five (5) personal devices. You may not resell, share, publicly display, upload, distribute or otherwise exploit the content without our express written permission.

7. Refund Policy

We want you to be satisfied. Because digital content is delivered instantly, all other sales are considered final unless otherwise required by law.

8. Taxes

Prices shown include U.S. sales tax where applicable. If your jurisdiction applies VAT, GST or similar taxes to digital goods, such taxes will be added at checkout or you may be responsible for self‑assessment and remittance, depending on local regulations.

9. Intellectual‑Property Disclaimers

10. Warranties & Liability

11. Dispute Resolution – Arbitration & Class‑Action Waiver

a. Binding Arbitration. Any dispute arising out of or relating to these Terms or your purchase shall be resolved exclusively by final, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
b. Class‑Action Waiver. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION.
